Torture Thought

So if torture kept America safe and was justifiable, why did field soldiers like Lynndie England face court martial and punishment for "keeping America Safe"? Note: of the 15 soldiers accused/convicted, 13 were below the rank of captain. Only one above the rank of staff sergeant was convicted.
